1. ABOUT TIAGO PRISCO FINE ART

These Terms & Conditions govern the purchase and use of artworks offered through Tiago Prisco Fine Art. By placing an order through the website, the customer acknowledges that they have had the opportunity to read and understand these Terms & Conditions before completing the purchase.

2. THE ARTWORK

Tiago Prisco Fine Art offers photographic artworks produced as limited-edition fine-art prints.
Each artwork is identified by its title or reference number, edition, available dimensions, production medium and other relevant specifications displayed on the product page.
The photographs are original artistic works created by Tiago Prisco. The physical print constitutes the artwork being sold; the purchase does not include the transfer of copyright or other intellectual property rights unless expressly agreed in writing.
Minor variations in colour, tone, texture or appearance may occur between the image displayed on a screen and the physical artwork due to differences between screens, viewing conditions and printing materials.

3. LIMITED EDITIONS

Each artwork is produced as part of a strictly limited edition.
The total number of physical prints available for a particular work and size will not exceed the edition stated on the website or certificate of authenticity, unless otherwise expressly stated.
Edition numbers are recorded as part of the artist's internal provenance records.
Once the stated edition has been completed, no additional prints of that edition will be produced.
Different dimensions may constitute separate editions where expressly identified as such.

4. MADE TO ORDER

Unless otherwise indicated, artworks are produced to order.
Production begins after payment has been confirmed and the order has been accepted.
Made-to-order production is part of the limited-edition process and allows each artwork to be individually produced, inspected, signed and documented.
The made-to-order nature of an artwork does not exclude or limit any mandatory consumer rights applicable to the transaction.

5. PRODUCT INFORMATION AND AVAILABILITY

The website will provide, to the extent applicable, information regarding the artwork, dimensions, edition, medium, price, availability, production time and delivery conditions.
Every reasonable effort is made to ensure that product information is accurate and current.
If an obvious technical, typographical or pricing error occurs on the website, Tiago Prisco Fine Art reserves the right to correct the error and, where legally permitted, contact the customer before fulfilling the order.
If an order has been placed based on an obvious error and the applicable law permits cancellation, the customer will be informed and any amount already paid will be refunded.

6. PRICES

Prices are displayed in the currency indicated on the website.
Unless otherwise stated, the artwork price does not necessarily include shipping, insurance, customs duties, import taxes, brokerage fees or other charges imposed by the destination country.
Any applicable additional charges known at the time of purchase will be disclosed in accordance with applicable law.
For international transactions, the final amount charged by a payment provider or financial institution may be affected by exchange rates, conversion fees or other charges imposed by that provider.

7. PAYMENT

Payment is processed through the payment method or third-party payment provider made available at checkout.
The customer must provide accurate and complete payment and billing information.
Tiago Prisco Fine Art does not intentionally retain complete payment-card information when payment is processed through an external payment provider.
An order will normally proceed to production only after payment has been successfully confirmed.

8. ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase the selected artwork under these Terms & Conditions.
An automated order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance where additional verification is required.
Tiago Prisco Fine Art may decline or cancel an order where there is a legitimate reason, including an obvious pricing or technical error, suspected payment fraud, inability to verify payment, or an edition being unavailable.
If an order is cancelled after payment has been received, the customer will be informed and the applicable refund will be processed.

9. ORDER CONFIRMATION AND RECORDS

After an order has been accepted, the customer will receive confirmation containing relevant information about the transaction.
The customer should retain the order confirmation, payment records, certificate of authenticity and any other documentation associated with the purchase.
Electronic records relating to the transaction may be retained for administrative, accounting, legal, provenance and customer-service purposes, in accordance with applicable law and the Privacy Policy.

10. PRODUCTION

Production begins after payment has been confirmed and the order has been accepted.
The estimated production period will be indicated on the website or communicated to the customer where applicable.
Production times are estimates and may vary due to printing, quality-control, material availability, framing, packaging, logistics or other circumstances.
Where a significant delay is anticipated, Tiago Prisco Fine Art will make reasonable efforts to inform the customer.

11. QUALITY CONTROL

Before shipment, each artwork is inspected to verify, as applicable:

  • the correct artwork;

  • the correct dimensions;

  • the correct edition number;

  • print quality;

  • material and finish;

  • signature;

  • certificate of authenticity;

  • packaging and general condition.
    Where appropriate, photographic documentation may be retained as part of the internal production and provenance record.

12. CERTIFICATE OF AUTHENTICITY

Each original limited-edition artwork is accompanied by a certificate of authenticity identifying relevant information about the work, which may include the artist, artwork title or number, date, edition, dimensions, medium and certificate or edition number.
The certificate should be retained by the owner as part of the artwork's provenance documentation.
The certificate confirms the authenticity and edition status of the physical artwork identified in it.
The certificate does not transfer copyright, reproduction rights, licensing rights or other intellectual property rights.

13. OWNERSHIP OF THE PHYSICAL ARTWORK

Upon completion of the purchase and delivery, ownership of the physical print transfers to the customer, subject to applicable law and the terms of the transaction.
Ownership of the physical artwork does not transfer copyright or any other intellectual property rights belonging to the artist.
The customer may possess, display and enjoy the physical artwork but may not reproduce, scan, copy, digitise, manufacture additional prints from it or otherwise commercially exploit the image without prior written authorization.

14. COPYRIGHT AND INTELLECTUAL PROPERTY

The photographs, images, website content, texts, visual materials and other intellectual property associated with Tiago Prisco Fine Art remain protected by applicable copyright and intellectual-property laws.
Tiago Prisco retains the copyright and other applicable intellectual property rights in the photographic works unless expressly transferred or licensed in writing.
The purchase of a physical artwork does not constitute a copyright assignment or image licence.
No right is granted to reproduce, distribute, publish, modify, merchandise, advertise, license, commercially exploit or otherwise use the image beyond the private ownership and display of the purchased physical artwork, unless expressly authorized in writing.
Brazilian copyright law expressly protects photographic works and gives the author rights concerning reproduction and other uses of the work.

15. DISPLAY OF PURCHASED ARTWORK

The purchaser may display the physical artwork in a private residence or other location where they are legally entitled to display it.
The purchaser may photograph the artwork as part of documenting their own interior or collection, provided that such use does not amount to unauthorized reproduction or commercial exploitation of the photographic work.
Any commercial use of the image itself requires prior written authorization.

16. THIRD-PARTY USE AND COMMERCIAL PROJECTS

The purchase of a physical artwork does not grant permission for the image to be used in:

  • advertising campaigns;

  • marketing materials;

  • editorial publications;

  • books or magazines;

  • websites or digital campaigns;

  • merchandise;

  • packaging;

  • product design;

  • commercial reproduction;

  • licensing;

  • resale of reproductions;

  • hospitality or commercial branding;

  • or any other commercial exploitation of the image.
    Requests for commercial image licensing should be directed to [LICENSING EMAIL].
    Each licence may be subject to separate terms, fees, territory, duration, media and permitted uses.

17. ARCHITECTURE, INTERIOR DESIGN AND HOSPITALITY PROJECTS

Tiago Prisco Fine Art may provide artworks and related services for architects, interior designers, art consultants, developers, hotels, restaurants, offices and other commercial or hospitality projects.
Large-scale, multi-work or professional projects may be subject to separate Trade Terms, Project Terms or a specific written agreement.
Such agreements may define, among other matters:

  • project scope;

  • selected artworks;

  • quantities;

  • dimensions;

  • materials and presentation;

  • trade or project pricing;

  • payment terms;

  • production schedule;

  • approvals;

  • delivery;

  • installation;

  • insurance;

  • licensing;

  • and permitted commercial use.
    Unless expressly agreed otherwise, purchasing physical artworks for a project does not automatically grant the project owner or professional client additional copyright or image-licensing rights.

18. SHIPPING AND DELIVERY

Shipping options, estimated delivery times and applicable shipping charges will be presented during the purchasing process where available.
Delivery estimates are not guarantees unless expressly stated otherwise.
The customer is responsible for providing a complete and accurate delivery address and contact information.
If incorrect or incomplete information supplied by the customer causes additional delivery costs or prevents delivery, the applicable consequences will be handled according to the circumstances and applicable law.
Where shipping insurance is offered or required, its terms may depend on the carrier or insurance provider.
Nothing in these Terms & Conditions is intended to exclude or improperly transfer any responsibility that applicable law places on the seller or supplier.

19. INTERNATIONAL SHIPPING

International orders may be subject to customs procedures, import duties, taxes, brokerage charges or other requirements imposed by the destination country.
Unless expressly stated otherwise at checkout, such destination-country charges are not included in the artwork price.
The customer is responsible for complying with applicable import requirements in their jurisdiction, subject to any mandatory legal responsibilities of Tiago Prisco Fine Art.
Delivery times for international orders may be affected by customs processing, inspections, carrier delays or other circumstances outside the artist's reasonable control.
Customers are encouraged to verify applicable import requirements before placing an international order.

20. DELIVERY DAMAGE

If an artwork arrives visibly damaged, the customer should contact Tiago Prisco Fine Art as soon as reasonably possible at [RETURNS EMAIL], providing:

  • order number;

  • photographs of the artwork;

  • photographs of the outer packaging;

  • photographs of the internal packaging;

  • photographs of the shipping label;

  • and a description of the damage.
    The customer should retain the artwork and all packaging until the matter has been resolved, unless otherwise instructed.
    Damage claims will be assessed and handled in accordance with applicable law and the circumstances of the shipment.

21. MANUFACTURING DEFECTS OR INCORRECT ORDERS

If the artwork contains a manufacturing defect, does not correspond to the order or has another qualifying issue, the customer should contact [RETURNS EMAIL] as soon as reasonably possible.
Depending on the circumstances and applicable law, the appropriate remedy may include repair, replacement, reprinting, price adjustment or refund.
Because artworks are produced as limited editions, any replacement must remain consistent with the edition structure and provenance records.
Where a replacement is not possible, another legally appropriate remedy will be provided.

22. RETURNS, CANCELLATIONS AND REFUNDS

Returns, cancellations and refunds are governed by applicable law and the separate Returns & Refunds Policy available on the website.
For online or other distance purchases, statutory consumer rights apply where applicable.
In Brazil, the Consumer Protection Code provides a seven-day withdrawal period for qualifying distance contracts, counted from the applicable statutory starting point, including receipt of the product.
The fact that an artwork is produced to order does not, by itself, eliminate mandatory statutory rights.
Where a statutory withdrawal right applies, the customer may exercise it according to the procedure established in the Returns & Refunds Policy and applicable law.
Where the law requires Tiago Prisco Fine Art to bear return shipping costs, such costs will be handled in accordance with applicable law.
Refunds will be processed according to the applicable legal requirements and, where relevant, through the original payment method.

23. CONDITION OF RETURNED ARTWORKS

Where an artwork is lawfully returned, Tiago Prisco Fine Art may inspect the artwork and its accompanying documentation, including its certificate of authenticity and edition number.
Returned artworks will not automatically be placed back into inventory.
The condition and provenance of the artwork will be documented as appropriate.
Where an artwork has been damaged, materially altered or otherwise affected during a return process, the parties' rights and responsibilities will be determined according to applicable law.

24. EXCHANGE OF ARTWORKS

Exchanges are not guaranteed unless required by applicable law or expressly offered by Tiago Prisco Fine Art.
Where an exchange is legally or contractually permitted, availability of the requested artwork and edition must be confirmed before the exchange is accepted.
Because each work belongs to a limited edition, exchanges may not always be possible.

25. PROMOTIONAL MATERIAL AND WEBSITE CONTENT

Tiago Prisco Fine Art may display images of artworks, installations and completed projects for portfolio, editorial, archival and promotional purposes, subject to applicable rights and permissions.
Where an artwork has been purchased by a private collector, reasonable efforts may be made to avoid identifying the collector without permission.
For professional or hospitality projects, separate project agreements may determine whether photographs of the completed installation may be used for portfolio or promotional purposes.

26. USE OF WEBSITE CONTENT

Unless expressly stated otherwise, all website text, photographs, graphics, logos, layouts, videos, designs and other content are protected by applicable intellectual-property laws.
No website content may be copied, reproduced, distributed, modified, published or commercially exploited without prior authorization, except where permitted by law.

27. WEBSITE AVAILABILITY

Reasonable efforts are made to maintain the website and its purchasing functionality.
However, continuous or uninterrupted availability cannot be guaranteed.
The website may occasionally be unavailable due to maintenance, technical problems, hosting issues, security measures or circumstances beyond reasonable control.

28. ERRORS AND TECHNICAL ISSUES

If the website contains a technical or typographical error affecting an order, product description, price, availability or other material information, Tiago Prisco Fine Art will take reasonable steps to correct the issue and, where legally required, inform affected customers.
Nothing in this section limits mandatory consumer rights.

29. FRAUD PREVENTION AND ORDER SECURITY

Orders may be subject to reasonable verification procedures designed to prevent fraud, unauthorized transactions and other security risks.

32. FORCE MAJEURE

Tiago Prisco Fine Art will not be responsible for delays or inability to perform obligations caused by circumstances beyond reasonable control, including natural disasters, serious disruptions to transportation, strikes, war, government restrictions, customs disruptions, widespread technical failures, public emergencies or other comparable events.
Where such circumstances occur, reasonable efforts will be made to inform affected customers and resume performance as soon as reasonably possible.
This provision does not exclude rights or remedies that cannot legally be excluded.

33. NO WAIVER OF LEGAL RIGHTS

Nothing in these Terms & Conditions is intended to exclude, restrict or waive any consumer right, statutory protection or legal remedy that cannot lawfully be excluded or restricted.
Where mandatory consumer or other applicable laws provide rights that differ from these Terms & Conditions, those mandatory provisions will prevail to the extent required by law.

34. SEVERABILITY

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
The invalid provision will be interpreted or replaced, where legally possible, in a manner that most closely reflects its original lawful purpose.

35. CHANGES TO THESE TERMS

Tiago Prisco Fine Art may update these Terms & Conditions from time to time to reflect changes in the business, website, services or applicable legal requirements.
The version applicable to a purchase will be the version made available to the customer at the time of the relevant transaction, subject to mandatory legal requirements.
The date of the latest revision will be indicated at the beginning of these Terms & Conditions.

36. GOVERNING LAW

These Terms & Conditions shall be interpreted in accordance with the laws applicable to the relevant transaction.
For transactions governed by Brazilian law, Brazilian law shall apply, subject to mandatory consumer protections and other applicable legal provisions.
For international customers, mandatory consumer protections applicable in the customer's jurisdiction may continue to apply where required by law.
Nothing in these Terms & Conditions is intended to prevent a consumer from exercising a mandatory right to access a competent court, authority or dispute-resolution mechanism where such right exists.

    In the event of a conflict, mandatory applicable law will prevail.

39. FINAL PROVISION

By completing a purchase through the website, the customer acknowledges that they have been given an opportunity to review these Terms & Conditions before completing the transaction.
These Terms & Conditions are intended to establish clear rules concerning the purchase, production, delivery, ownership and use of limited-edition photographic artworks while preserving all rights and protections that cannot lawfully be excluded.
